Massachusetts lawmakers have advanced Senate Bill 302 (SB 302), signaling a major shift in the state's gambling regulation. The measure targets US online sportsbooks and retail operators, aiming to limit risk for bettors while increasing state revenues.
What is SB 302 All About?
Known as the Bettor Health Act, SB 302 was introduced by Sen. John Keenan of Quincy. The bill proposes several sweeping changes to the state's sports betting framework.
It seeks to ban in-play or live wagering, which allows bettors to place bets during games. Additionally, the bill would prohibit proposition bets (prop bets), including wagers on player-specific or statistical outcomes independent of final game results.
SB 302 also sets daily and monthly wagering limits, restricting individuals to $1,000 per day and $10,000 per month per operator. Operators must perform affordability checks to ensure bettors do not wager more than 15% of their bank accounts.
Another major component is a tax rate increase on gambling operators, raising it from 20% to 51% of gross gaming revenue. The 155% increase is expected to shock local companies.
Proponents argue this aligns Massachusetts with other states while funding the Public Health Trust Fund to support responsible gambling programs.
The bill goes further by prohibiting advertising during televised sporting events and banning the use of "bonus bets" or "odds boosts" in marketing. This is done since legislators deem it deceptive for bettors.
It also targets VIP hosting, forbidding operators from paying employees based on a percentage of a high-roller's deposits.
How and Why SB 302 was Advanced
The bill received a unanimous 5-0 approval from the Joint Committee on Economic Development and Emerging Technologies. Legislators cited concerns about gambling addiction, the rapid growth of the sports betting market, and recent incidents involving student-athletes wagering on their own performances.
Lawmakers emphasized that SB 302 promotes public safety and consumer protection.
"We unleashed an industry promoting betting on anything imaginable, 24 hours a day," Sen. Keenan said.
He added that the bill aims to reduce harms associated with excessive betting, restrict deceptive marketing, and ensure the state receives revenue to fund recovery and research initiatives.
Reception of SB 302
Supporters, including Rep. Lindsay Sabadosa and Sen. Patricia Jehlen, praised SB 302 for its focus on responsible gambling, consumer protection, and advertising limits.
Critics, particularly from the sports betting industry, warn the restrictions could drive US online sportsbooks to unregulated markets and discourage investment in Massachusetts.
Meanwhile, some operators expressed concern that banning prop bets, live wagering, and marketing tools like odds boosts may limit product offerings and reduce revenue.
Next Steps and Potential Impact
Currently, SB 302 is in the Committee Phase. To become law, it must first clear the Senate Ways and Means Committee. Then, it has to pass a full vote on the Senate floor.
After that, the bill needs to be introduced and approved by the House of Representatives. Finally, Governor Maura Healey will need to sign it into law.
If enacted, the legislation could significantly reshape Massachusetts gambling. SB 302 will increase tax revenue while restricting certain bet types, advertising, and VIP programs.
It may also influence how US online sportsbooks operate. SB 302 would require stricter monitoring of wagers and adherence to daily and monthly limits.
