The New York State Gaming Commission (NYSGC) has asked a Manhattan court to compel prediction market operator Kalshi to comply with investigative subpoenas. The regulator says it needs the records to assess potential violations of state gambling laws and determine whether civil penalties are warranted.
The petition names Kalshi Inc. and KalshiEX LLC as respondents. The New York State Courts Electronic Filing System recorded the petition as received on October 22, 2026.
Gaming attorney Daniel Wallach subsequently posted pages of the petition online on October 23. The Gaming Commission is represented in the proceeding by the New York Attorney General's Office, led by Letitia James.
New York Alleges Kalshi Withheld Key Records
The Commission issued the subpoenas on July 31, 2026, setting an August 14 deadline for Kalshi to respond. However, regulators allege that the company refused to produce certain documents and provided insufficient responses to other requests.
"Kalshi has flatly refused to produce any documents in response to Requests… which are undeniably relevant to the Gaming Commission's investigation into Kalshi's mobile sports wagering operations in New York," reads the petition.
The requested records cover four main areas: Kalshi's sports-event contracts, offerings available to New Yorkers under 21, advertising materials, and corporate ownership. Regulators particularly want information about advertisements describing the company's products as bets or wagers.
These records could help investigators assess the scope of Kalshi's operations in the state. They could also inform the Commission's decision on whether to impose civil penalties under New York's Racing, Pari-Mutuel Wagering and Breeding Law.
Dispute Centers on New York Gambling Laws
The investigation reflects a wider disagreement over how authorities should regulate prediction markets. New York maintains that sports-event contracts offered by Kalshi may constitute sports wagering under state law.
Licensed US online sportsbooks in New York must comply with the state's licensing requirements and age restrictions. Regulators are investigating whether Kalshi's offerings operate outside that framework, including whether younger customers can access its sports-related contracts.
Kalshi, meanwhile, argues that the Commodity Futures Trading Commission (CFTC) regulates its event contracts as financial instruments. The company maintains that federal law governs these products, challenging state efforts to restrict its operations.
The dispute has already reached federal court. In July 2026, the US District Court for the Southern District of New York denied Kalshi's motion for a preliminary injunction seeking to block New York regulators, allowing the state's enforcement efforts to proceed.
The Commission's petition also comes amid broader legal action against Kalshi. New York Attorney General Letitia James and Governor Kathy Hochul previously announced a separate lawsuit alleging that Kalshi operated an unlicensed gambling business.
Together, these actions reflect the state's effort to determine whether the company's sports-related contracts violate New York gambling laws.
Court Decision Could Shape the Next Steps
The Commission is asking the court to compel Kalshi to produce the requested records. It says the information is necessary to determine whether violations occurred and, if so, what penalties might apply.
However, the subpoena dispute does not itself establish that Kalshi violated New York law. The court must first consider the Commission's request. Currently, no ruling on the petition had been reported in the cited coverage.
The case also highlights the broader conflict between state gambling regulators and federal authorities over prediction markets. Its outcome could affect how New York investigates sports-event contracts and how operators defend their activities against state-level enforcement.
For the New York gambling industry, the immediate issue is whether the Commission can obtain the records it says are essential to its investigation.
The wider legal question remains whether Kalshi's sports-event contracts fall under state gambling laws or federal oversight.
