Defining the Ban Under SB 2104

SB 2104 seeks to modernize the Mississippi Code of 1972. It broadens the legal definition of prohibited gambling devices. The bill specifically targets platforms that mimic traditional casino experiences online. To clarify the scope, the bill provides a strict legal definition:

"Any online, interactive, or computerized version of any game… including, but not limited to, online race books, online sports pools, and online sweepstakes casino-style games, is hereby declared to be a gambling device, and the offering for play or operating an online or interactive platform that offers for play such games within the State of Mississippi shall be deemed unlawful under the provisions of this section."

Furthermore, the bill introduces much harsher penalties for violators. It upgrades the crime of operating these platforms from a misdemeanor to a felony. Those found guilty could face up to ten years in prison. 

Additionally, the courts may impose fines reaching $100,000. The legislation also authorizes the forfeiture of assets used in these illegal activities. State officials believe these tools will effectively dismantle unauthorized networks.

The ban would significantly alter the landscape for online casino operators in the region. Currently, many sweepstakes sites occupy a legal gray area. They often claim they do not offer real-money gambling. However, SB 2104 removes this ambiguity entirely.
