Louisiana legislators have introduced a sweeping new criminal justice proposal that would redefine certain Louisiana gambling offenses as racketeering crimes. 

House Bill 53 (HB 53) aims to overhaul how the state prosecutes illegal gaming, particularly targeting online sweepstakes-style operations that have skirted traditional gambling rules.

The measure, put forward by Republican Rep. Bryan Fontenot, would classify multiple gambling-related offenses as predicate acts under Louisiana's racketeering statutes. If passed, prosecutors could pursue broader enterprise-style cases against unlicensed operators, rather than charging isolated gambling violations.

What Does House Bill 53 Entail?

HB 53 does not introduce new prohibitions on gaming itself. Instead, it amends existing racketeering law to include certain Louisiana gambling crimes among the listed racketeering activities.

Under the proposed language, "racketeering activity" would cover the following actions:

  • gambling
  • gambling by computer
  • gambling by electronic sweepstakes device
  • unlawful wagering
  • related offenses punishable under Title 14 of the Louisiana Revised Statutes of 1950.

Rep. Fontenot's bill is now under review by the House Administration of Criminal Justice Committee. Its backers argue this change could give state prosecutors more powerful tools to dismantle organized gaming networks. Critics, however, warn it could blur lines between regulated gaming and other online platforms.

Racketeering Penalties Under the Bill

If enacted, HB 53 would tie sweepstakes-style gambling offenses to racketeering penalties, which are among the harshest in Louisiana law. Conviction for racketeering can lead to fines of up to $1 million. Along with this, prison terms of up to 50 years at hard labor, or both, can also be part of the sentence.

Additionally, if the monetary value of the racketeering violation exceeds $10,000, offenders would face a mandatory minimum of five years in prison without eligibility for parole, probation, or suspension of sentence.

The bill's racketeering definitions mirror those in existing state statute, which already include a broad range of criminal conduct. If HB 53 passes, the scope of what constitutes organized criminal behavior will expand to cover more types of illegal gaming.

Louisiana is the latest state to pursue legislative action against sweepstakes casino models that have proliferated across the US in recent years. Similar efforts have taken place in states such as Montana, Connecticut, New York, and others, each using varied legal frameworks to curb unregulated gaming.

The focus on sweepstakes-style offerings reflects growing concern about unregulated platforms operating in gray areas of the law. Players often participate in games that mimic real-money betting without formal licensing or consumer protections.

Moreover, the legislative push reflects a broader national debate over how sweepstakes platforms differ from regulated gambling models. Unlike licensed US online casinos, sweepstakes-style sites often operate outside formal oversight, taxation, and consumer protection frameworks. 

Lawmakers argue this distinction creates enforcement challenges, especially as digital gaming continues to expand across state lines.

As HB 53 moves through the legislative process, Louisiana's gaming landscape could shift significantly. This marks a tougher approach to combating illegal gambling and organized crime connected to sweepstakes-style operations.
