The Nebraska online sports betting campaign has reached a pivotal stage after the ballot committee, Nebraskans for Economic Opportunity, submitted more than enough petition signatures before the state's filing deadline. 

The successful submission moves the proposal one step closer to appearing on the November 2026 general election ballot.

The Nebraska Secretary of State must now verify the signatures before certifying the measures for the ballot. Meanwhile, Tax Relief Nebraska has continued leading the public campaign in support of expanded mobile wagering. 

They argue that regulated online betting could generate additional state revenue while keeping more wagering activity within Nebraska.

Supporters believe regulated mobile wagering would allow US online sportsbooks to operate under state oversight. Furthermore, it would also strengthen Nebraska gambling through a legal and taxable market.

Nebraska Online Sports Betting Campaign Gains Momentum

Momentum continues to build for Nebraska's online sports betting campaign after Nebraskans for Economic Opportunity submitted petition signatures before Nebraska's July 2 filing deadline. 

As the ballot committee behind the initiative, it delivered two separate petitions to the Nebraska Secretary of State after collecting well above the required number of signatures.

Organizers intentionally built a substantial buffer because election officials routinely invalidate some signatures during the verification process. Both petitions must satisfy statewide signature requirements and Nebraska's geographic distribution rules before qualifying for the November 2026 ballot.

While Nebraskans for Economic Opportunity handled the petition submission, Tax Relief Nebraska has served as one of the campaign's leading advocates. The group promotes online betting to boost tax revenue for property relief. This also captures lost out-of-state wagers.

"Our totals exceeded what was required on both measures and we're confident we've done enough to access the ballot," said Jordan McGrain, a petition sponsor for Tax Relief Nebraska.

The Two Petitions Work Together

The proposal consists of two complementary ballot measures that must both receive voter approval.

The first petition seeks a constitutional amendment authorizing the Nebraska Legislature to legalize online sports betting. Without the amendment, lawmakers cannot expand the state's existing retail-only market to include mobile wagering.

The second petition establishes the statutory framework that would regulate online sports betting if voters approve the constitutional amendment. It outlines how the state would oversee licensing, operations, and enforcement once online wagering becomes legal.

Together, the two measures provide both the legal authority and the regulatory structure needed to launch a statewide online sports betting market. Supporters adopted this dual-petition approach to avoid requiring lawmakers to draft separate implementing legislation after the election.

Industry Welcomes Latest Campaign Milestone

The petition submission has been met with optimism from campaign organizers and gaming industry stakeholders. Supporters believe exceeding the required signature threshold gives the initiative a strong chance of qualifying for the November ballot after the verification process concludes.

Several major gaming organizations have supported the campaign, including the Sports Betting Alliance. Its members include leading US online sportsbooks such as BetMGM, DraftKings, Fanatics Sportsbook, and FanDuel. 

Supporters argue many Nebraska residents already place wagers through neighboring states or offshore platforms, resulting in lost tax revenue for the state.

However, opponents of expanded mobile wagering are placing their case. They have traditionally argued that allowing betting through smartphones could increase gambling participation and make wagering more accessible to vulnerable individuals. 

They also contend that any additional tax revenue should be weighed against potential social costs associated with problem gambling and increased demand for treatment services.

The latest development also follows several unsuccessful legislative efforts to authorize statewide mobile wagering. After those proposals stalled, supporters shifted their focus to Nebraska's citizen initiative process, allowing voters to decide the issue directly.

Nebraska Online Sports Betting Framework

The proposed framework would expand Nebraska's current sports betting market rather than replace it. Retail sportsbooks currently operate only at licensed casinos after voters approved casino gambling and retail sports betting in 2020.

If voters approve both measures, licensed casino operators could partner with approved online sportsbook platforms to offer mobile wagering statewide. State regulators would oversee licensing, compliance, consumer protections, and enforcement.

Supporters also argue the proposal would strengthen Nebraska gambling by directing more wagering into a regulated market instead of offshore sportsbooks. They believe the framework would improve consumer protections while creating new tax revenue for the state.

What Happens Next?

The Nebraska Secretary of State will now verify the submitted signatures to determine whether both petitions meet all legal requirements. Officials must confirm the total number of valid signatures and ensure the petitions satisfy Nebraska's geographic distribution requirements.

If both initiatives qualify, they will appear on the November 2026 general election ballot.

Nebraska voters will then decide whether to approve the constitutional amendment and the accompanying statutory measure. Both proposals must pass because they were designed to work together.

If voters approve both measures, state lawmakers and regulators can begin implementing Nebraska's regulated online sports betting market. If either measure fails, however, the proposal cannot move forward under its current structure.
